MIAMI – A cook alleges he was not paid overtime wages during his employment with a pizza restaurant.
Maurizio Procopio filed a complaint on Feb. 26 in the U.S. District Court for the Southern District of Florida against AR Espanola LLC, doing business as Numero 28, and Rolando Biamonte citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds AR Espanola LLC and Biamonte responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for hours worked that exceeded 40 hours per week.
The plaintiff requests a trial by jury and seeks damages, all legal fees, and any other relief as the court deems just. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
