Man claims Select Portfolio Servicing Inc. breached duty regarding application

MIAMI – A Broward County consumer alleges he was damaged because of the way his loan servicer handled his loss mitigation application.

Mauro Cevenini filed a complaint on Feb. 21 in the U.S. District Court for the Southern District of Florida against Select Portfolio Servicing Inc. alleging violation of the Real Estate Settlement Procedures Act.

According to the complaint, the plaintiff alleges that he has suffered harm and damages and additional expenses as a result of defendant's wrongful conduct of making successive requests for additional information to complete plaintiff's loss mitigation application. The plaintiff holds Select Portfolio Servicing Inc. responsible because the defendant allegedly failed to advise plaintiff whether his loss mitigation application was either complete or incomplete, or advise him of any information necessary to complete the application in a timely and accurate manner.

The plaintiff requests a trial by jury and seeks judgment in his favor in the total amount of damages, together with an award of attorney’s fees and litigation costs. He is represented by Jeffrey N. Golant of Coral Springs in Coral Springs.
