Consumer claims HSBC Mortgage Services Inc. failed to timely respond to request

MIAMI – A Broward County man alleges his mortgage servicer failed to timely respond to his requests for information.

Walter B. Rattray filed a complaint on Feb. 21 in the U.S. District Court for the Southern District of Florida against HSBC Mortgage Services Inc. citing the Real Estate Settlement Procedures Act.

According to the complaint, the plaintiff alleges that he has suffered harm and damages from receiving correspondence from the defendant asserting that the plaintiff had failed to make monthly mortgage payments. The suit states the plaintiff disproved such assertions and repeatedly sent qualified written requests to the defendant to specify the months it did not receive the plaintiff's payment. The suit states the defendant did not respond until the third request.

The plaintiff holds HSBC Mortgage Services Inc. responsible because the defendant allegedly failed to adequately and timely respond to plaintiff's requests for information and caused plaintiff monetary damages.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, attorney’s fees and litigation costs. He is represented by Jeffrey N. Golant of The Law Offices of Jeffrey N. Golant PA in Coral Springs.
