NEW PORT RICHEY – A trustee is accusing an insurer of failing to pay benefits under a life insurance policy.
Hank Iskandar, as trustee of the Ronald W. Wenang Irrevocable Trust, filed a complaint on Jan. 9 in the
6th Judicial Circuit Court - Pasco County against Athene Annuity and Life Co. alleging breach of contract.
According to the complaint, the plaintiff alleges that in 2003, the insured Ronald Wenang suffered a stroke and was rendered permanently disabled and remained disabled until his death on June 15, 2015. The suit states that in 1992, the defendant notified Wenang that his monthly premiums would be suspended as long as he was disabled, and that the policy's ownership was transferred to the plaintiff's trust in 1994.
The suit states that in 2003, the defendant sent letters to Wenang requesting a follow-up physician statement, Wenang never received the letters, and that the policy lapsed in 2003. The plaintiff alleges the defendant never sent a notice of policy lapse for nonpayment and that the defendant has wrongfully failed to pay benefits under the policy.
The plaintiff requests a trial by jury and seeks judgment against the defendant, plus interest, attorney's fees, costs and any other relief that the court deems proper. He is represented by Joseph J.
