Former High Point Drywall employee alleges he was not properly compensated for overtime work

MIAMI – A Lauderdale Lakes employer is accused of paying a former laborer straight pay for overtime work.

Jaime E. Banegas-Hernandez filed a complaint on Jan. 10 in the U.S. District Court for the Southern District of Florida against High Point Drywall LLC, Leonardo Aguilar and Juan Sanin citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that from 2013 until termination on Nov. 15, 2016, he regularly worked an average of 88 hours per week but his overtime work was paid in cash by the defendants at the straight time rate.

The plaintiff holds High Point Drywall LLC, Aguilar and Sanin responsible because the defendants allegedly failed to properly pay overtime compensation and failed to deduct the appropriate taxes from plaintiffs' overtime pay.

The plaintiff requests a trial by jury and seeks judgment against defendants, liquidated damages totaling $27,790, actual damages, costs of action, attorney's fees, and any other damages that the court deems just.
