MIAMI – A Miami woman alleges a debt collector harassed her with calls over an alleged debt she claims she does not owe.
Theodora Edmond filed a complaint on Jan. 6 in the U.S. District Court for the Southern District of Florida against Credit Counsel Inc. alleging that the Florida corporation violated the Telephone Consumer Protection Act or TCPA through intrusive and unwanted calls.
According to the complaint, the plaintiff alleges that the defendant contacted her in 2015 to collect a debt she alleges she does not owe. The plaintiff holds Credit Counsel Inc. responsible because the defendant allegedly called plaintiff with such frequency meant to abuse or harass, utilized an automatic telephone dialing system, and contacted plaintiff without prior express consent.
The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages of $1,500 for each and every violation, order enjoining defendant from calling plaintiff’s cellular telephone by use of an automatic dialing system, and further relief as justice may require.
