MIAMI – A Plant City couple has filed a class action against a consumer reporting agency and a check guarantee services over allegations their credit reports were sold and obtained without a permissible purpose.
John and April Heistand filed a complaint individually and on behalf of a class of similarly situated persons on Jan. 5 in the U.S. District Court for the Southern District of Florida against Experian Information Solutions Inc. and United Tranzactions LLC (UTA) citing the Fair Credit Reporting Act.
According to the complaint, the plaintiffs allege UTA began calling them in October 2015 in an attempt to collect an alleged debt from April Heistand. The plaintiffs allege that they were harmed because UTA's agents pretended to be law enforcement agents or associated with law enforcement.
They alleges UTA further caused damages to plaintiffs' privacy by requesting a credit report from Experian without permissible purpose, which they allege is a violation of the FCRA.
The plaintiffs request a trial by jury and seek judgment against defendants; order certifying the case as a class action; permanent injunction; statutory, actual and punitive damages; interest; attorneys’ fees; costs; and other relief as the court deems just.
