Man seeks reinstatement to disability benefits

ORLANDO – A man is challenging his insurer's claim that he is not disabled.

Charles I. Nash filed a complaint on Jan. 13 in the U.S. District Court for the Middle District of Florida, Orlando Division against The Standard Insurance Co. alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on May 13, 2016, he suffered damages as a result of defendant's denial of his long-term disability benefits. The plaintiff holds The Standard Insurance Co. responsible because the defendant allegedly denied and/or terminated his disability claim finding that he was not disabled under the terms of the plan, while the plaintiff claims he remains disabled under ERISA terms.

The plaintiff requests a trial by jury and seeks relief from defendant for the payment of disability benefits, reinstatement to all other benefits, attorney’s fees, costs and further relief as the court deems proper. He is represented by Gregory D. Swartwood of The Nation Law Firm LLP in Longwood.
