Man alleges Klausner Lumber One terminated him in retaliation for taking leave

LIVE OAK – A man alleges he was terminated from his position as shift supervisor for taking a leave for the birth of his child.

Aubrey P. Land Jr. filed a complaint on Jan. 13 in the 3rd Judicial Circuit Court of Florida - Suwannee County against Klausner Lumber One LLC citing the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that in August 2016, he submitted a request for a leave of absence under FMLA for the birth of his son and took a one-week leave of absence. He alleges upon his return from leave, his employment was immediately terminated in retaliation for exercising his rights to FMLA leave.

 The plaintiff holds Klausner Lumber One LLC responsible because the defendant allegedly acted with malice and reckless disregard for plaintiff's federally protected rights.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, interest, attorneys' fees, costs, and other relief as the court may deem just. He is represented by Jay P. Lechner of Whittel & Melton LLC in St. Petersburg.
