Life Insurance Company of North America accused of wrongly denying benefits

MIAMI — A woman is suing Life Insurance Company of North America, alleging breach of contract.

Davina French filed a complaint on Jan. 20 in the U.S. District Court for the Southern District of Florida Miami Division against Life Insurance Company of North America, alleging that the insurance firm wrongly denied her claim for long-term disability benefits.

According to the complaint, the plaintiff alleges that in July 2015, she became disabled due to cervical disc herniation and cervical radiculopathy, and later applied for long-term disability benefits but was denied. The plaintiff holds Life Insurance Company of North America responsible because the defendant allegedly upheld its decision to deny the plaintiff's claim for long-term disability benefits despite appeals and sufficient medical evidence.

The plaintiff seeks unpaid long-term disability benefits plus interest, all legal fees and any other relief as this court deems just. She is represented by Edward P. Dabdoub and Carter Meader of Wagar Dabdoub, P.A. in Coral Gables.
