Former employee accuses City of Sanibel of pregnancy discrimination

FORT MYERS — A woman is suing The City of Sanibel, a Florida municipality, citing alleged pregnancy/sexual discrimination.

Ashley Price filed a complaint on Jan. 13, in the U.S. District Court for the Middle District of Florida against The City of Sanibel alleging that the Florida municipality breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that in November 2011, she commenced working for the defendant as an administrative secretary; became pregnant in June 2012 and immediately notified her superiors of her condition; and on Aug. 29, 2012, suddenly and unjustifiably received an unsatisfactory performance rating and was told the very same day to resign and was further advised to use her pregnancy/health condition as the reason for her resignation, which caused her to suffer economic and emotional damages. The plaintiff holds The City of Sanibel responsible because the defendant allegedly retaliated against the plaintiff by inducing her to file for resignation in exchange for severance pay, and terminated her employment without justifiable reason other than discrimination against her for her pregnancy.

The plaintiff requests a trial by jury and seeks actual, compensatory and punitive damages, attorneys' fees, costs of action and further relief as the court may deem just. She is represented by Jason L. Gunter, Conor P. Foley of Jason L. Gunter PA in Fort Myers.
