Truck driver alleges Swift Transportation terminated him in retaliation

CLEARWATER – A truck driver alleges he was terminated in retaliation for taking a medical leave.

Michael Coleman filed a complaint on Jan. 5 in the 6th Judicial Circuit of Florida - Pinellas County against Swift Transportation Co. of Arizona LLC alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that, in August 2009, he started working for the defendant as a truck driver. He alleges he suffers from various medical conditions that qualify as serious within the meaning of the FMLA, however, the defendant retaliated against his use of FMLA leave by reducing his runs and pay and proceeded to terminate his employment in August 2016.

The plaintiff holds Swift Transportation Co. of Arizona LLC responsible because the defendant allegedly interfered with plaintiff's rights under the FMLA, and retaliated against plaintiff for exercising his rights under the FMLA.

The plaintiff requests a trial by jury and seeks judgment against defendant, injunctive relief, compensation for lost wages, benefits and other remuneration, reinstatement to a previous position with back pay and other benefits, front pay, liquidated damages, interest, costs, attorney's fees and further relief as the court deems just.
