CLEARWATER – An insurance company is accused of interfering with a former employee's rights to the Family and Medical Leave Act.
Raymond E. McIver filed a complaint on Jan. 10 in the 6th Judicial Circuit Court of Florida - Pinellas County against American Strategic Insurance Corp. citing the Fair Labor Standards Act and the Family and Medical Leave Act.
According to the complaint, the plaintiff alleges that he requested medical leave in July 2016 but was told by the defendant that he would be terminated if he did not come to work. He alleges he was later terminated. The plaintiff holds American Strategic Insurance Corp. responsible because the defendant allegedly retaliated against the plaintiff for exercising his rights to FMLA and also did not pay him overtime wages during his employment.
The plaintiff requests a trial by jury and seeks lost wages, benefits, reinstatement, front pay, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Matthew K. Fenton of Wenzel Fenton Cabassa PA in Tampa.
