Couple claims Suntrust Bank does not have their permission to call them

FORT MYERS – An couple in Estero alleges a bank keeps frequently calling them despite their requests for the calls to stop.

Ronald Yacopino and Joanne Yacopino filed a complaint on Jan. 12 in the U.S. District Court for the Middle District of Florida, Fort Myers against Suntrust Bank citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiffs allege that in September 2015, they suffered damages from receiving several collection calls on their cellular telephones from the defendant seeking to collect an alleged debt. The plaintiffs holds Suntrust Bank responsible because the defendant allegedly continued to call the plaintiffs several times using an automatic telephone dialing system despite plaintiffs' request to stop calling them in September and November 2016.

The plaintiffs request a trial by jury and seek statutory damages, punitive damages, actual damages, all legal fees plus interest and any other relief as the court deems just. They are represented by Shaughn C. Hill of Morgan & Morgan, Tampa, P.A. in Tampa.
