MIAMI – A Miami-Dade County man alleges he worked an average of 60 hours a week and was not paid proper overtime pay.
Teudy Portuondo filed a complaint on behalf of all others similarly situated on Jan. 11 in the U.S. District Court for the Southern District of Florida against Concept Auto Inc., Mike Kvachuk and Marat Kvachuk citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week and was not paid any overtime compensation during his employment from August to December 2016. The plaintiff holds Concept Auto Inc., Mike Kvachuk and Marat Kvachuk responsible because the defendants allegedly failed to pay the plaintiff any overtime premiums at a rate of time-and-one-half for hours worked that exceeds 40.
The plaintiff requests a trial by jury and seeks all overtime wages still owing, all legal fees plus interest and any other relief as the court deems just. He is represented by J.H. Zidell of J.H. Zidell P.A. in Miami Beach.
