FORT LAUDERDALE – A driver for a Broward County employer claims he is owed unpaid overtime wages.
Henry Avila filed a complaint on Jan. 9 in the U.S. District Court for the Southern District of Florida against CWC Transportation LLC, Carlos Assayag, Clemente E. Cruz William Masaro alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he worked for more than 40 hours a week as a driver but was not paid any overtime compensation. The plaintiff holds CWC Transportation LLC, Assayag, Cruz and Masaro responsible because the defendants allegedly refused to pay the plaintiff overtime wages at a rate of time-and-one-half of his regular rate of pay.
The plaintiff requests a trial by jury and seeks damages, all legal fees and any other relief as the court deems just. He is represented by Elliot Kozolchyk of Koz Law PA in Fort Lauderdale.
