Walmart shopper claims leaking cooler caused fall

Slip01

BRADENTON – A Walmart shopper alleges a leaking beverage cooler caused a fall at the Palmetto location.

Terri D. Wood filed a complaint on Dec. 23 in the 12th Judicial Circuit Court of Florida - Manatee County against Wal-Mart Stores East LP alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 21, 2015, she suffered bodily injury, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical expenses and aggravation of a previously existing condition from a fall caused by an unattended wet floor inside defendant's store premises. The plaintiff holds Wal-Mart Stores East LP responsible because the defendant allegedly failed to keep a safe environment for customers, failed to warn of the dangerous situation created by the wet surface, and failed to inspect the subject premises for the presence of dangerous defects, which posed a hazard to its business invitees.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of more than $15,000. She is represented by Steven E. Heintz of Heintz & Becker in Bradenton
