Former employee alleges Freeman Security Services Inc. misclassified him as contractor

ORLANDO – A security guard alleges his former employer paid straight time for overtime work.

Randall Brocius filed a complaint on behalf of himself and those similarly situated on Dec. 22 in the U.S. District Court for the Middle District of Florida, Orlando Division against Freeman Security Services Inc. citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for the defendant from January 2014 to June 2016 as a security guard. The plaintiffs hold Freeman Security Services Inc. responsible because the defendant allegedly misclassified plaintiff as an independent contractor and did not pay overtime wages a rate of time-and-one-half of his regular rate of pay.

The plaintiffs request a trial by jury and seek judgment against defendant for unpaid overtime wages, liquidated damages, interest, attorney's fees, costs incurred, declaratory relief and further relief as the court determines just. He is represented by Matthew R. Gunther of Morgan & Morgan PA in Orlando.
