OCALA – A Lake County man alleges a creditor has harassed him with phone calls.
Robert Patterson filed a complaint on Dec. 22 in the U.S. District Court for the Middle District of Florida, Ocala Division against Selene Finance LP citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
According to the complaint, the plaintiff alleges that in April 2016, he verbally advised defendant to stop calling his cellular telephone to collect an alleged debt. Despite revoking any of its right to call, the defendant allegedly continued to call him.
The plaintiff holds Selene Finance LP responsible because the defendant allegedly called and left messages to plaintiff with such frequency meant to abuse or harass, unlawfully utilized an automatic dialer and automated voice, and contacted plaintiff without prior express consent.
The plaintiff requests a trial by jury and seeks judgment against defendant, actual and statutory damages, costs of action, attorney's fees, and other relief the court deems just. He is represented by Christopher W. Boss of Boss Law in St. Petersburg.
