FORT MYERS — A couple's lawsuit against Navient Solutions Inc., a debt collector, alleges violation of the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.
Thomas Travers and Barbara Travers filed a complaint on Dec. 29 in the U.S. District Court for the Middle District of Florida against Navient Solutions Inc., alleging that the defendant called the plaintiffs several times in an attempt to collect an alleged debt.
According to the complaint, the plaintiffs allege that since June 2015, they suffered damages from receiving approximately 1,000 collection calls. The plaintiffs holds Navient Solutions Inc. responsible because the defendant allegedly used an automatic telephone dialing system to call the plaintiffs and continued making calls after being told to stop.
The plaintiffs request a trial by jury and seek statutory damages, punitive damages, actual damages, interest, all legal fees, an injunction against the defendant and any other relief as this court deems just. They are represented by Octavio Gomez of Morgan & Morgan, Tampa, P.A. in Tampa.
