MIAMI – A reseller of heath and wellness products is seeking judgment regarding a Wisconsin company's allegations of unauthorized sales.

Pureformulas Inc. filed a complaint on Dec. 29 in the U.S. District Court for the Southern District of Florida against Ortho Molecular Products Inc. seeking declaratory judgment and injunctive relief.

According to the complaint, the plaintiff alleges that from 2009 to 2016, it purchased products directly from the defendant and sold them on pureformulas.com. The suit states that in May 2016, the plaintiff received a letter from the defendant accusing it of unauthorized sales and sought for the plaintiff to discontinue selling its products. The plaintiff alleges these claims are false but that the defendant has rejected attempts to resolve the matter.

The plaintiff seeks declare that plaintiff's prior sales and advertising of the defendant's products were not unlawful, all legal fees and any other relief as the court deems just. It is represented by Jorge Espinosa and Robert R. Jimenez of Espinosa Trueba Martinez PL in Miami.
