Motorist files suit against State Farm over underinsured motorist claim

SANFORD – A Sanford motorist alleges his insurer wrongfully denied his claim after an accident.

Anthony G. Duvall filed a complaint on Dec. 15 in the 18th Judicial Circuit Court for Seminole County against State Farm Mutual Automobile Insurance Co. alleging violation of Florida statues.

According to the complaint, the plaintiff alleges that on Nov. 6, 2015, he was traveling southbound on state Route 415 at the intersection of Celery Avenue when underinsured tortfeasor Nina M. Shorthouse made an illegal turn in front of plaintiff and struck plaintiff's motor vehicle. As a result, the plaintiff alleges he sustained serious and personal injury and alleges the defendant denied his uninsured motorist claim.

The plaintiff holds State Farm Mutual Automobile Insurance Co. responsible because the defendant allegedly denied that coverage exists and/or refused to pay plaintiff for the full value of the claim, failed to adopt and implement standards for the proper investigation of claims, and failed to act promptly upon communications with respect to plaintiff's uninsured motorist claim.

The plaintiff requests a trial by jury and seeks judgment against defendant for the total damages suffered by plaintiff, interest, attorney's fees, costs, and other relief the court deems proper. He is represented by Karl W. Labertew of Dan Newlin & Partners in Orlando.
