ORLANDO – A woman alleges that her former Seminole County employer failed to provide employees overtime pay.
Keywee Owens filed a complaint on behalf of herself and all others similarly situated on Dec. 15 in the U.S. District Court for the Middle District of Florida, Orlando Division against The Advocator Group LLC citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that on May 31, 2016, she began working for the defendant as a customer care representative until July 20, 2016. She alleges she and other similarly situated employees worked in excess of 40 hours in a week but were never compensated for their overtime hours at a rate equal to one-and-one-half times their regular rate of pay. She alleges she was terminated for complaining about these practices. The plaintiff holds The Advocator Group LLC responsible because the defendant allegedly failed to pay plaintiff an overtime premium and failed to accurately record all hours worked by the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against defendant, unpaid overtime wages, designate collective action, notify all similarly situated employees, declaratory judgment of defendant's unlawful practices, compensatory damages, costs, attorney's fees, and further relief as the court deems just.
