Former chauffeur seeks allegedly unpaid overtime wages

MIAMI – A former chauffeur alleges he worked more than 60 hours per week and was not paid overtime.

Clever Valencia filed a complaint on Dec. 19 in the U.S. District Court for the Southern District of Florida, Miami Division against Simon Falic citing the Fair Labor Standards Act.

According to the complaint, the defendant hired the plaintiff in 1997 to be a chauffeur and personal assistant and he held that position until 2015. The plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Falic responsible because the defendant allegedly failed to pay the plaintiff any overtime premium for working more than 40 hours per week and did not keep accurate time records.

The plaintiff requests a trial by jury and seeks actual damages, unpaid overtime compensation, interest, liquidated damages, all legal fees and any other relief as the court deems just. He is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
