Kimberly Deveney sues Gulf Coast Breathe Free MSO for negligence leading to severe injuries

In the case of Kimberly Deveney vs. Gulf Coast Breathe Free MSO, LLC, filed in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida under case number 502024CA003150XXXAMB Div: AN on April 4, 2024, the plaintiff is seeking damages exceeding $50,000. Represented by attorneys Chad N. Horowitz and Lynda S. Brennan, Deveney alleges negligence on part of the defendant leading to severe injuries.

The incident took place on May 19, 2023 at Breathe Free Sinus & Allergy Centers located in West Palm Beach where Deveney was a business invitee. After undergoing a Nasal Endoscopy performed by Dr. Cody B. Aull, D.O., she was being transported to her vehicle by Surgical Technician Brandi Morris via wheelchair when Morris decided to use stairs instead of an elevator.

During this transportation process, Morris lost control of the wheelchair while descending the stairs causing Deveney to hit her head and knees against a concrete wall and subsequently fall backward onto the pavement with the wheelchair landing on top of her.

Deveney is seeking judgment for damages proven at trial, costs of suits, interests where applicable, attorney’s fees and any other relief deemed just and proper by the court.
