Pressure Washer Service sues Phoenix Properties for breach of lease agreement

In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, Pressure Washer Service, Inc. filed a lawsuit against Phoenix Properties International Inc., also known as Phoenix Properties, Inc. The case, identified as Case Number: 24-001107-Cl and filed on March 7, 2024, involves an action for specific performance and declaratory judgment related to a property dispute.

The plaintiff alleges that they entered into a Commercial Gross Lease with the defendant on November 1, 2016, to lease a commercial building located at 205 South Belcher Road, Clearwater, Florida. The initial term of the lease was set to expire on December 31, 2022. However, with the permission of the defendant, the plaintiff's tenancy transitioned into a month-to-month tenancy.

On February 21, 2024, the defendant informed the plaintiff that it had contracted to sell the property and demanded that the plaintiff execute a Tenant Estoppel and Attornment Certificate. In response to this notice on February 28th, the plaintiff exercised its Right of First Refusal under the lease and requested a copy of the contract to sell along with wire instructions for immediate closing on the sale of the property.

The plaintiff is seeking for judgment and damages due to breach of contract by Phoenix Properties International Inc., who allegedly sold their leased property without honoring their right of first refusal. The value of this property exceeds $50,000 exclusive of interest, attorney’s fees and costs.
