In the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, a civil lawsuit was filed by plaintiff Thomas Cerney against defendants Christina Lee Flatau and Allstate Fire and Casualty Insurance Company. The case number is 24-001047-Cl, and it was filed on March 5, 2024. The lawsuit seeks damages in excess of $50,000 for an automobile accident that occurred on December 18, 2020.

The plaintiff, represented by an undisclosed counsel, alleges that he was lawfully operating a motor vehicle when he was involved in an accident with defendant Christina Lee Flatau. As a result of this collision, Cerney claims to have sustained injuries. He further alleges that at the time of the accident, he held uninsured/underinsured motorist coverage provided by co-defendant Allstate Fire and Casualty Insurance Company.

The lawsuit accuses Flatau of negligence and reckless driving which led to the collision. It states that as a direct result of her actions, Cerney has suffered permanent personal injuries, impairment, disability, disfigurement, mental anguish, loss of capacity for enjoyment of life and earning capacity along with medical expenses for treatment.

Cerney is seeking judgment against Flatau for damages exceeding $50,000 plus costs associated with the action and any other relief entitled under Florida law. Additionally, he has also made an uninsured/underinsured motorist benefits claim against Allstate Fire and Casualty Insurance Company due to insufficient Bodily Injury Liability Coverage from Flatau at the time of the accident.
