Assistant property manager alleges former employer violated FLSA

DeLAND, Fla. — A Volusia County woman is suing her former employer, alleging violation of the Fair Labor Standards Act (FLSA).

Bernadette Hennan filed a complaint Aug. 1 in Volusia County Circuit Court against Pegasus Residential LLC, alleging failure to compensate employees proper wages and benefits.

According to the complaint, Hennan began working for Pegasus in 2015 as an assistant property manager, a non-exempt employee under the FLSA. The plaintiff alleges in July 2017, she was wrongfully terminated, causing her to suffer severe financial and emotional damages as a result of the wrongful conduct of the defendant.

Hennan says she was fired because of her objecting to not being allowed to use the required break time to express milk and that the Pegasus did not provide her with a location to express her milk. She also alleges she did not receive the proper compensation for hours worked beyond 40 hours per week. 

The plaintiff alleges Pegasus Residential failed to compensate her for all the hours worked beyond 40 hours a week in accordance with the FLSA, discharged Hennan for pretextual reasons and retaliated against her for engaging in protected activity under the FLSA.

Hennan seeks trial by jury compensatory damages of more than $15,000, declaratory relief and all further just relief. She is represented by attorney Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
