Man files suit against Tijuana Flats Burrito Co. after allegedly finding bandage in guacamole

ORLANDO – A Volusia County man alleges he suffered medical expenses and mental anguish when he discovered a bandage in catered food at a holiday party.

James Connell filed a complaint on June 1 in the 9th Judicial Circuit Court of Florida - Orange County against TJF Holding Co. LLC, doing business as Tijuana Flats Burrito Co., alleging that the caterer failed to exercise reasonable care in handling food.

According to the complaint, the plaintiff alleges that on Dec. 17, 2015, the defendant was catering a holiday party he was attending. He alleges he took a bite of a guacamole and discovered a used bandage in the food prepared by the defendant.

The plaintiff holds TJF Holding Co. LLC responsible because the defendant allegedly allowed employees to prepare food without following proper sanitary procedures and failed to identify and correct the unsanitary condition of its catered food.

The plaintiff seeks judgment against defendant for compensatory damages of more than $15,000, exclusive of interest and costs. He is represented by David A. Shekhter of Politis & Matovina PA in Port Orange.
