Man accuses US Oncology of age discrimination

A former employee of US Oncology says he was a victim of age discrimination.

Tod Shawn Garthwaite filed his complaint in federal court against US Oncology Corporate Inc.

Garthwaite claims he faced age discrimination under Title VII of the Civil Rights Act of 1964 and the Age Discrimination in Employment Act. He also cites violations of the Florida Civil Rights Act of 1992. In addition to these charges, Garthwaite is invoking the court's supplemental jurisdiction over claims of intentional civil theft of his funds, breach of contract – both written and verbal – and unjust enrichment.

According to the complaint, the plaintiff began working with a company called Cancer Care LLC in March 1997 as a radiation therapist. This company later was purchased by Vantage Oncology Inc., which subsequently was acquired by US Oncology Corporate Inc. in January 2017. At this point, Garthwaite had been promoted to Director of Operations for the Brevard County facility.

Garthwaite claims he did not face any employment issues until Laurie Snyder became his supervisor in June 2022. He alleges Snyder was not involved in any aspect of his day-to-day work and typically only held one or two meetings per month.

While working for US Oncology, Garthwaite received an annual salary of $147,000 along with a contractual non-discretionary annual performance incentive based on certain performance measures.
