PALM BEACH – A disabled woman alleges a Boca Raton company denied her full and equal access of the premises because of illegal barriers.
Janet Hoyt filed a complaint on March 22 in the U.S. District Court for the Southern District of Florida, Palm Beach Division against Patio.Com LLC. doing business as Patio.com, alleging violation of the Americans with Disabilities Act.
According to the complaint, the plaintiff alleges that she visited the defendant's premises in December 2016. The plaintiff holds Patio.Com LLC responsible because the defendant allegedly failed to design and construct such premises to be accessible to and accommodate persons with disabilities, including a proper water closet seat at the correct height, provide the flush controls on the open side of the water closet, provide mirrors above lavatories or countertops.
The plaintiff requests a trial by jury and seeks judgment against defendant, declaratory relief, an order for the defendant to alter its premises, attorneys' fees, all costs, expenses of suit, and further relief as it may deem necessary.
