FORT LAUDERDALE – A Key Biscayne company and a Miami corporation claim their trademark is being used on insulated drinkware without authorization.

Kryo Entertainment LLC and Kryogenifex Inc. filed a complaint on Feb. 24 in the U.S. District Court for the Southern District of Florida against Kryo Gear LLC alleging trademark infringement and other counts.

According to the complaint, the plaintiffs allege that they registered and are the owners of the Kryo mark. The plaintiffs hold Kryo Gear LLC responsible because the defendant's use of the Kyro mark allegedly has deprived the plaintiffs of money and profits.

The plaintiffs request a trial by jury and seek enjoin the defendant from further infringing their marks, pay all profits and damages, transfer the domain name www.kryogear.com to the plaintiff, order the destruction of all infringing materials, treble profits and damages and all legal fees.
