FORT MYERS — A design firm is suing Traina Enterprises Inc. d/b/a T.E.I. Industries, Douglas Traina, Mimi Groom, LHS of Southwest Florida LLC d/b/a Luxury Home Solutions, Norman Bloxham, Handley's Residential Design Inc. and Stephen C. Handley, Florida corporations, citing alleged copyright infringement.

Harrell & Co. Architects-Florida Inc. filed a complaint on Nov. 27, in the U.S. District Court for the Middle District of Florida against the defendants alleging that they violated laws by unauthorized reproduction and sale of an intellectual property.

According to the complaint, the plaintiff alleges that, in 2013, Harrell & Co. Architects-Florida Inc. is the creator and original owner of an architectural design entitled and advertised as "777 Gulf Shore." However, plaintiff discovered that the defendant has infringed on the copyrighted work by advertising, designing, marketing, constructing or selling of one or more residences which were copied from plaintiff's design. 

The plaintiff holds Traina Enterprises Inc. d/b/a T.E.I. Industries, Douglas Traina, Mimi Groom, LHS of Southwest Florida LLC d/b/a Luxury Home Solutions, Norman Bloxham, Handley's Residential Design Inc. and Stephen C. Handley responsible because the defendants allegedly benefitted from the infringing design at the expense of plaintiff, and contributed to the infringement by aiding with the construction or sale of the properties at issue.

The plaintiff requests a trial by jury and seeks judgment in its favor, damages, costs of action, attorney's fees and further relief as is just. They are represented by Jon D. Parrish of Parrish, White & Yarnell PA in Naples.
