Ocwen Loan Servicing LLC accused of harassment over phone calls

TAMPA – A Hillsborough County man claims a debt collector harassed him with robocalls.

Carlos Cortes filed a complaint on Sept. 6 in the Tampa Division for the Middle District of Florida against Ocwen Loan Servicing LLC alleging that the debt collector violated the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning in June 2014, he started receiving calls from the defendant in an effort to collect an alleged consumer debt using an automatic telephone dialing system or artificial or pre-recorded voice. He claims he informed the defendant’s agent that its incessant calls were harassing him and demanded to immediately cease all calls to his cellular telephone, however, repeated requests were all ignored, which caused plaintiff to suffer from stress, anxiety, and loss of happiness and privacy. 

The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly violated the TCPA by bombarding plaintiff with calls using an autodialer and continued its campaign of abuse by continuing to call plaintiff despite not having an express consent to call.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory damages, punitive damages, actual damages, costs, interest, attorney's fees, enjoinder from further violations and other relief the court may deem just. He is represented by Jared M. Lee of Morgan & Morgan PA in Orlando.
