MIAMI – A widow is suing a Miami-based cruise line alleging it did not pay the benefits owed to her after the death of her husband.

Ludis Johany Pereira Rojas, as the personal representative of the estate of the decedent Oscar Enrique Rocha Payares, filed a complaint on May 27 in the U.S. District Court for the Southern District of Florida against Silversea Cruises LTD and V. Ships Leisure LTD, doing business as V. Ships Leisure LLC, alleging breach of contract.

According to the complaint, the decedent was an employee of the defendants and died of cancer. The plaintiff holds the defendants responsible because the defendants allegedly only paid $10,000 for the decedent's burial but failed to pay the additional $75,000 to the plaintiff and $15,000 for each dependent child. The suit states that these benefits were to be paid as per the contract between the decedent and the defendants.

The plaintiff requests a trial by jury and seeks damages of more than $75,000, interest and all legal fees. She is represented by Ricardo V. Alsina of Lipcon, Margulies, Alsina & Winkleman PA in Miami.
