Employees file suit alleging Al-Flex Exterminators owes overtime wages

MIAMI – A Miami-Dade County employer is accused of not paying its employees overtime wages.

Alejandro Tamayo Diaz, Dariel Fontela, Nelson Mendez, Jose Reyes, Alberto Ruiz, Arian Rodriguez and Luis Vega Barroso filed a complaint on May 2 in the U.S. District Court for the Southern District of Florida Miami Division against Al-Flex Exterminators Inc. and Alexander E. Napoles alleging that they allegedly violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they regularly worked for more than 40 hours per week but were not properly compensated at the rate of time-and-a-half of their hourly rate. The plaintiffs holds Al-Flex Exterminators Inc. and Alexander E. Napoles responsible because the defendants allegedly refused to pay overtime premiums, failed to keep adequate time records and paid some of them below the minimum wage standards.

The plaintiffs request a trial by jury and seek payment for all overtime premium that were not properly compensated, payment of wages paid below the minimum wage standards, liquidated damages, prejudgment interest, reasonable attorney’s fees and costs and all other appropriate relief. They are represented by Domingo C. Rodriguez of Rodriguez Law Office LLC in Miami.
