FORT MYERS – A suit has been filed against a Collier County certified public accountant alleging that he owes unpaid income tax liabilities and other penalties.

United States of America filed a complaint on April 20 in the U.S. District Court for the Middle District of Florida Fort Myers Division against Albert J. Wagner alleging that the Collier County resident failed to comply with the Internal Revenue provisions.

According to the complaint, the plaintiff alleges that it has not receive payment for defendant's unpaid income tax liabilities in the amount of $131,082 and for unpaid civil penalties in the amount of $118,346.12 for purportedly promoting abusive tax shelters. The plaintiff holds Wagner responsible because the defendant allegedly failed to accurately report his income tax liabilities for the years 2001 to 2003 and 2005, failed to pay income tax in 2005, 2006, 2009 and 2013 and failed to fully pay the assessed tax and penalties as of March 28.

The plaintiff requests a trial by jury and seeks judgment against the defendant for income tax liabilities in the amount of $131,082 any further interest, judgment against defendant for unpaid civil penalties in the amount of $118,346.12, plus any further interest and for such other relief that is just and equitable. It is represented by Michael M. May of U.S. Department of Justice in Washington, D.C.
