FORT MYERS – An individual with disabilities has filed suit against the trustees of a Fort Myers property over allegations it does not comply with Americans with Disabilities Act regulations.

Patricia Kennedy filed a complaint on April 4 in the U.S. District Court for the Middle District of Florida, Fort Myers Division against trustees Mark Bruno, Salvatore M. Bruno Jr. and Diane Korvanen for Salvatore Bruno Trust alleging that the property owners failed to comply with the standards for new construction and alteration requirements.

According to the complaint, the plaintiff alleges that she suffered and continues to suffer indirect injury, frustration and humiliation and was denied full, safe and equal access to the good, services, facilities and accommodations being offered to the public at 8711 Cypress Lake Drive. The plaintiff holds the defendants responsible because the defendants allegedly failed to adhere to a policy to ensure that all goods, services and facilities are readily accessible to and usable by persons with disabilities, failed to have accessible doorways and failed to have accessible routes connected to the parking area,.

The plaintiff requests a trial by jury and seeks an order requiring defendant to alter the property to make it accessible to individuals with disabilities, an order directing defendant to make modifications their policies and procedures toward persons with disabilities, attorney's fees and costs and any further relief as the court may deem just and proper.
