MIAMI – A woman alleges that a cruise line's negligence led to the death of her brother.
Tamblyn Cubero, as personal representative of the estate of Frank Flippo, deceased, Brent Phillip Flippo and Abigail Marie Flippo
filed a complaint on March 14 in the U.S. District Court for the Southern District of Florida against
Royal Caribbean Cruises LTD, doing business as Royal Caribbean Cruise Line and Royal Caribbean International, citing wrongful death and negligence.
According to the complaint, the plaintiff alleges that on March 22, 2015, her brother Frank Flippo consumed so much alcohol causing his judgment to become substantially impaired and fell overboard as he was approaching the outer railings of the vessel. The plaintiff holds Royal Caribbean International responsible because the defendant allegedly failed to properly design its vessel for the safety of its passengers, failed to train its crew not to serve excessive amounts of alcohol to passengers, failed to have adequate security for passengers on open decks and failed to closely monitor its closed-circuit televisions.
The plaintiff seeks the following: compensation for all damages, prejudgment interest and all court costs. They are represented by Scott A. Wagner of Moore & Co. PA in Coral Gables.
