ORLANDO -- A man is suing his former lawyer for legal malpractice.
Timothy Viens filed a complaint on August 6 in Orange County Circuit Court against Halim Law and Steven A. Halim for legal malpractice and breach of fiduciary duties.
According to the complaint, on October 3, 2018, the plaintiff retained the legal services of the Defendants to represent his interests in connection with a civil action that was initiated against him for the actions of replevin, conversion, civil theft, constructive trust, unjust enrichment and fraudulent transfer.
Viens paid the sum of $10,000 as a retainer to Halim. On December 7, 2018, Halim appeared at trial and requested a continuance based upon an illness, and the trial was rescheduled for May 20, 2019. The day before trial, the court struck his proposed witness list, precluding those on it from testifying.
Viens alleges Halim committed many errors to the detriment of him and that resulted in material harm.
Viens seeks damages, pre-judgement interest, attorney's fees and cost of suit. Viens is represented by himself.
