ORLANDO -- A man is suing the manufacturer of his ICD and the man performing an MRI after going into cardiac arrest and nearly dying.
Yessin Ashmawy filed a complaint on June 23 in Orange County Circuit Court against John Doe and Boston Scientific Corporation for general negligence, vicarious liability and corporate negligence.
According to the complaint, on Oct. 2, 2019, Ashmawy presented to Advent Health Orlando for a cardiac MRI. Ashmawy had previously been implanted with an Implantable Cardioverter Defibrillator (ICD) manufactured by Boston Scientific.
John Doe was in charge of putting Ashmawy's ICD into MRI Protection Mode, the suit says. John Doe began the MRI and allegedly left the area. While in the MRI, Ashmawy began experiencing ventricular fibrillation which led to cardiac arrest and ultimately a Code Blue, the suit says.
John Doe was not present to take Ashmawy's ICD out of MRI Protection Mode which would have allowed the ICD to restart his heart, the suit says. Ashmawy alleges it is John Doe's negligence that caused him to be in cardiac arrest for 13 minutes and nearly die.
