Orlando homeowner says insurance company denied coverage for hurricane damage

ORLANDO — An Orlando homeowner is suing an insurance company, alleging breach of contract.

Flor Marie Duran, also known as Flor Marie Ojeda, filed a complaint Aug. 23 in Orange County Circuit Court against Universal Property & Casualty Insurance Company, alleging the defendant failed to pay the full value of the plaintiff's covered losses.

According to the complaint, on Sept. 10, 2017, Duran notified Universal Property of the damages sustained to her dwelling at 10117 Dean Point Place, Orlando, due to Hurricane Irma. Duran says she has complied with all conditions precedent to entitle her to recover under the policy. 

However, Duran alleges, she has failed to be compensated the full amount for her losses as required despite receiving an assigned claim with a date of loss from the defendant. 

The plaintiff alleges Universal Property & Casualty Insurance has failed or refused to fully perform under the policy to fully value Duran's losses and failed to fully pay all of her losses as required by the insurance policy.

Duran seeks trial by jury, damages of more than $15,000 with interest on any overdue payments, plus attorney fees and court costs. She is represented by attorney James J. Dye of Morgan & Morgan PA in Orlando.
