New York City couple say they were induced into entering contract

ORLANDO — A New York couple is suing a Florida timeshare corporation, alleging breach of contract and fraud.

Belfield Lashley and Bettie Green-Lashley of the Bronx, New York, filed a complaint Aug. 20 in Orange County Circuit Court against Lando Resorts Corporation and Vacation Village at Parkway Owners Association Inc. alleging violation of the Florida Vacation Plan and Timesharing Act.

According to the complaint, on Aug. 18, 2014, Lashley and Green-Lashley were sold by the defendants a "timeshare plan" on timeshare property known as Vacation Village at Parkway in Kissimmee. 

The plaintiffs allege they were induced to enter into contracts for the purchase of timeshares as the defendant employed unreasonable and false sense of urgency and duress to secure a sale without allowing the benefit of reflection. 

As a result, the plaintiffs say they have not had proper and adequate opportunity to decipher the offered contracts and documents. 

The plaintiffs allege the defendants made false statements with the purpose and intent to induce Lashley and Green-Lashley to rely on them and purchase the timeshare. The suit also alleges the defendants induced the plaintiffs to execute various documents without the benefit of review by rushing them through the signing period, and without explaining the nature of the terms contained within the written documentation.

Lashley and Green-Lashely seek trial by jury, actual damages of more than $15,000, attorney fees, court costs, treble damages, interest and all other just and proper relief. They are represented by attorney Anthony G. Franqui of Totten, Franqui, Davis & Burk, LLC in Fort Lauderdale.
