Customer alleges gym used defective equipment

CLEARWATER — A customer is suing LA Fitness, alleging liability and negligence in causing a head injury to the plaintiff.

Derrick Stoudemire filed a complaint June 21 in Pinellas Circuit Court against Fitness International LLC, doing business as LA Fitness, alleging failure to provide a safe environment.

According to the complaint, on Oct. 27, 2017, Stoudemire suffered a blow to the head while using equipment at the LA Fitness gym at 320 E. Bay Drive, Clearwater. The suit says Stoudemire sustained bodily injury, resulting in pain and suffering, disability, mental anguish, loss of the capacity for the enjoyment of life, and she incurred medical expenses. She blames defective gym equipment on the defendant's business premises. 

The plaintiff alleges LA Fitness failed to properly maintain its gym equipment, failed to make a reasonable inspection of the premises, and failed to warn Stoudemire of the dangerous condition of its premises.

Stoudemire seeks trial by jury, damages in excess of $15,000, together with costs, interests and all relief the court deems proper. She is represented by attorney Jeremy S. Clark of Pearlman & Clark PA in St. Petersburg.
