Patient alleges further injury after undergoing surgery

ORLANDO — A patient is suing Orange County health care providers, alleging medical malpractice and negligence.

Ramiro Rodriguez filed a complaint June 20 in Orange County Circuit Court against Dr. Banji Awosika, West Orange Vascular Center, West Orange Nephrology LLC and West Orange Dialysis Services LLC, alleging failure to provide medical care, diagnosis and treatment to patients within the prevailing standard of care. 

According to the complaint, on June 8, Rodriguez was under the care of the defendants to undergo a fistulogram and gave his consent to the procedure. The suit says a possible angioplasty, however, was not advised, and Rodriguez did not consent that any stent or stents would be placed in his veins. 

As a result, Rodriguez says he was misdiagnosed and misrepresented, that his dialysis fistula was defective and/or malfunctioning, and that the recommended and performed procedures were not medically indicated. 

The plaintiff alleges the defendants failed to diagnose, appreciate and note that the migrating stent had not been adequately immobilized by their attempt to capture or immobilize it and that the stent had again migrated further toward Rodriguez's heart.

Rodriguez seeks trial by jury, damages of more than $15,000, costs of action, pre- and post-judgment interest, and all other just relief. He is represented by attorney R. Barry Morgan of Morgan Law Office PA in Orlando.
