Shopper alleges injuries from exploding Seagram's wine cooler bottle

CLEARWATER — A Pinellas County shopper is suing a product distributor, alleging insufficient measures were taken to prevent injuries and negligence.

CLEARWATER — A Pinellas County shopper is suing a product distributor, alleging insufficient measures were taken to prevent injuries and negligence.

Tamra Marley filed a complaint June 15 in Pinellas County Circuit Court against Great Bay Distributors Inc. alleging the defendant negligently and carelessly handled a product, causing injuries.

According to the complaint, on March 7, 2016, Marley was purchasing a four-pack of bottles of Seagram's wine cooler that was distributed by Great Bay Distributors from a Save-A-Lot grocery store. The suit says, without warning, a bottle suddenly and violently exploded.

Marley says this caused her grievous bodily injuries, resulting in pain, disability, permanent and significant scarring, mental anguish and expense of hospitalization, medical care and treatment. 

The plaintiff alleges Great Bay Distributors breached the implied warranty of fitness to consumers of its products for retail sale.

Marley seeks trial by jury, damages in excess of $15,000, exclusive of costs, interest, attorney fees and all other just and proper relief. She is represented by attorneys Craig R. Lynd and Jeffrey S. Kaufman of Kaufman & Lynd PLLC in Orlando.
