ORLANDO — Two Orlando property owners are suing an insurer, alleging breach of an insurance contract.
David and Isabel Gonzalez filed a complaint May 25 in Orange County Circuit Court against Heritage Property and Casualty Insurance Company, alleging failure to pay for water damages.
According to the complaint, on Feb. 12, 2016, the Gonzalez property at 7969 Strada Drive, Orlando, was under a homeowners insurance policy when it sustained a covered loss for water damage due to a leaking roof.
However, despite efforts of the plaintiffs to comply with all post-loss obligations, the suit says, the defendant failed to provide the necessary reimbursement for a covered loss.
The plaintiffs allege Heritage Property and Casualty Insurance has failed to timely evaluate and pay benefits owed to them under the terms of the insurance policy.
The Gonzalezes seek trial by jury, damages of more than $15,000, plus interest, attorney fees and all other just relief. They are represented by attorney Leo A. Manzanilla of MSPG Law Group PA in Coral Gables.
