Condominium association alleges unit owner failed to pay assessments

CLEARWATER — A Pinellas County condo association is suing a property owner, alleging refusal to apply payments.

Patrcian Oaks Condominium Association Inc. filed a complaint May 29 in Pinellas County Circuit Court against J. Mark Clemente, alleging failure to pay assessments imposed against the property.

According to the complaint, n 2018, Patrcian Oaks had a property lien with Clemente in the Patrician Oaks unit VII by virtue of a warranty leasehold estate deal. According to the suit, Clemente failed to pay the assessments imposed against the property that were properly adopted by the association. 

As a result, the association continues to suffer and incur monetary damages and interest; and is entitled to foreclosure its lien. 

The plaintiff alleges Clemente has failed to properly pay the assessments imposed against the property that were properly adopted by the association.

Patrcian Oaks Condominium Association seeks trial by jury, damages less than $15,000, exclusive of interest, late fees, costs, attorney fees, excluding any amounts that may have been discharged in bankruptcy.
