Orlando homeowner alleges insurer failed to cover hurricane damage

Insurance 04

ORLANDO — An Orlando homeowner is suing an insurer, alleging breach of contract.

Scott Sindelar filed a complaint April 30 in Orange County Circuit Court against Federated National Insurance Company, alleging failure to pay for hurricane damage.

According to the complaint, on Sept. 11, 2017, Sindelar's property and dwelling at 11149 Bugenhagen Drive, Orlando, was damaged by Hurricane Irma, a covered peril under the policy issued by Federated National. Despite the demand for payment, the suit says, the defendant has failed or refuses to pay all of plaintiff’s bills and or estimates.

The plaintiff alleges Federated National Insurance has breached the insurance contract by refusing to pay full value for roofing and/or construction services to Sindelar, and forced the plaintiff to retain an attorney in bringing legal action.

Sindelar seeks trial by jury, damages of more than $15,000, judgment for all unpaid bills with interest on any overdue payments, court costs, attorney fees and all other remedies the court grants. He is represented by attorney Caleb Payne of Cohen Law Group in Maitland.
