CLEARWATER — Two Largo property owners are suing an insurer, alleging breach of contract.

Michael Gentile and Holly Lego filed a complaint May 2 in Pinellas Circuit Court against Heritage Property & Casualty Insurance Company, alleging failure to pay for hurricane damage. .

According to the complaint, on Sept. 10, 2017, Gentile and Lego's property at 6715 121st Ave. Largo, sustained damaged property and repair costs due to substantial damage from Hurricane Irma while the insurance policy was in full force and effect. However, the suit says, Heritage Property has denied all or part of the claim for insurance benefits. 

The plaintiffs allege Heritage Property & Casualty Insurance breached the insurance contract by not paying for all the loss and/or damage owed under the policy, and forced the plaintiffs to retain an attorney to protect their interest.

Gentile and Lego seek trial by jury, compensatory damages of more than $15,000, pre-judgment interest, costs and attorney’ fees, and all relief the court deems just. They are represented by attorney Michael B. Germain of Germain Law Group in Tampa.
